2. Data and Material Confidentiality

All client-provided information—including customer databases, campaign strategies, analytics reports, and design briefs—will be treated as strictly confidential.

Such data will not be:

Shared with third parties, subcontractors, or affiliates without written consent.

Used for purposes outside the project scope.

3. Intellectual Property Ownership

All creative works (designs, graphics, ad copies, campaigns, and media assets) produced under a contract remain the joint property of the client and Appewise Sdn Bhd, unless stated otherwise in a written agreement.

Neither party may resell, distribute, or transfer the materials to external parties without mutual written authorization.

4. Security Measures

We apply strong security protocols, including:

Controlled access to digital project folders.

Encrypted file transfer and storage.

Version control and access logs for design assets.

NDAs signed by all staff handling creative content.

5. Data Retention

Marketing data and creative assets are retained only for the duration required by the project or maintenance period. Upon request, they can be securely deleted or transferred to the client.

6. Third-Party Platforms

Where third-party tools (e.g., social media, analytics, or ad servers) are used:

Appewise complies with their respective data protection requirements.

Only authorized representatives will access such platforms.

No unauthorized data export or replication will occur.

7. Breach & Misuse Response

In case of suspected unauthorized disclosure or misuse, Appewise will:

Immediately suspend access to affected systems.

Inform the client in writing within 24 hours.

Conduct a full investigation and take corrective actions.

8. Enforcement and Legal Protection

Both parties agree that violations of confidentiality or IP ownership may result in legal action, damages, or contract termination under applicable Malaysian law.
